What is ganzo.cz

Ganzo.cz offers a range of Chinese brand Ganzo / Firebird, Ganzo.cz is a direct importer and retailer of this brand.

I. Basic provisions

Seller
Jan Carbol, ID No.: 76676668, VAT No.: CZ7809214985, with registered office at Horní 3039/114, 70030 Ostrava 30, Czech Republic, registered in the Trade Register kept by the Municipality of Ostrava. The natural person is a VAT payer.
 
Buyer
The buyer is a customer who is interested in purchasing the offered goods and agrees to the wording of the GTC. The buyer confirms his/her agreement to the GTC by sending an order through the system or other ordering channel (e-mail, telephone).

II. Ordering goods

Ordering goods through the e-commerce system www.ganzo.cz, by delivering an e-mail order to the Seller's address or by phone is considered a binding order. The order must contain all the necessary data required for its implementation (number and type of goods, name, address and contact details of the Buyer). Orders can be processed 24 hours a day/7 days a week.
In the case of ordering goods through the e-shop www.ganzo.cz, the Buyer will receive a notification of the order acceptance by the system to the e-mail address specified in the order. Subsequently, the Buyer will receive an Order Confirmation together with a payment request to the same address as soon as possible. The Seller reserves the right to cancel the order or part of it. In this case, the Seller will contact the Buyer and inform him of the situation. The prices quoted are inclusive of 21% VAT.

III. Payment terms

The ordered goods can be paid for in the following ways:

  • by bank transfer to an account with mBank (CZ)
  • by bank transfer to a Slovak account with Fio in EUR currency (SK, DE, AU and others)
  • bank transfer to a Polish account with Fortissimo in PLN currency (PL)
  • by credit card via GoPay (CZ, SK)
  • upon receipt of the parcel sent on delivery in cash or by credit card (CZ, SK)
  • The PlatímPak payment method is provided by Raiffeisenbank a.s, Hvězdova 1716/2b, 140 78 Praha 4, ID No. 49240901, registered in the Commercial Register maintained by the Municipal Court in Prague, file No. B 2051 ("Bank"). The payment method consists in the Customer paying the purchase price of the Goods and any costs of insurance, transport of the Goods by the Bank providing the Customer with a deferred payment for this purpose on the basis of the PlatímPak Service Agreement and transferring the funds directly to the Merchant's account.
    In the event that the Customer uses the PayPak service offered by the Merchant and provided by the Bank, the Customer is obliged to pay the deferred payment in the amount of the purchase price of the Goods and any costs of insurance, transport of the Goods to the Bank within the due date in accordance with the Terms and Conditions of the PayPak service.
    The Customer enters into a PayPak Service Agreement with the Bank, and the Terms and Conditions of the PayPak Service form an integral part of this Agreement. By choosing the PayPak Service, the Customer agrees to the Terms and Conditions of the PayPak Service.
    The Customer acknowledges that the Bank processes the Customer's personal data in the manner described in the Memorandum on Processing of Personal Data of the Bank's Customers, the current version of which can be found at www.rb.cz.

IV. Delivery of goods

Czech Republic

Due to time constraints, handover will be proposed in the evening at the Mobelix furniture store in Ostrava Dubina. This place and time is not a requirement, you just need to arrange at least one day in advance.

Abroad (Slovakia, Poland, Germany, Austria and others)

The goods are sent to Slovakia only after the amount is credited to the account 2400047755/8330 (FIO - bank in Slovakia, you do not pay any international payment fees).

Payment by cash on delivery is possible with mail order, PPL and DPD

Packaging

In order to keep shipping costs as low as possible, there is no packaging charge.

Shipping time

In most cases, the ordered goods are dispatched the next working day after the payment is credited to the Seller's account in case of payment by card or bank transfer. And also the next working day after the order in case of payment on delivery.

In the event of a delay in shipment, the Buyer is notified of this at the e-mail address specified in the order.

The Buyer will receive the invoice/tax document with all necessary details electronically to the email account specified in the order.

If payment is not credited to the Seller's account within 14 calendar days, the order is automatically cancelled and no additional obligations are incurred by either party.

In the event of non-collection of the shipment within the deadline given by the carrier, the shipment is returned to the Seller. For redelivery, the Seller charges a shipping fee of the same amount.

V. Right to withdraw from the contract

"You have the right to withdraw from this contract within 14 days without giving any reason."

You have the right to withdraw from the contract without giving any reason within 14 days from the day after the day on which you or a third party appointed by you takes delivery of the goods.

In order to exercise your right of withdrawal, you must inform the Seller of your decision to withdraw from this contract in the form of an unequivocal statement (e.g. a letter sent via a postal service provider or email). You may use the enclosed sample withdrawal form, but it is not your obligation to do so.

In order to comply with the deadline for withdrawal from this contract, it is sufficient to send the withdrawal before the expiry of the relevant deadline.

VI. Consequences of withdrawal from the contract

If you withdraw from this Contract, we will refund all payments we have received from you, including delivery costs, without undue delay and no later than 14 days from the date we receive your notice of withdrawal (excluding any additional costs incurred as a result of your chosen method of delivery being other than the cheapest standard delivery method offered by us).

We will use a bank transfer to refund payments. In no case will this incur additional costs for you.

We will only refund the payment once we have received the returned goods.

a) Acceptance of goods

Send the goods back to the Seller's address without undue delay, no later than 14 days from the date of withdrawal from this contract. The time limit is deemed to have been observed if you send the goods back to us before the expiry of the 14 days.

b) Costs associated with the return of goods

You will bear the direct costs of returning the goods.

c) Liability for diminished value of returned goods

You shall only be liable for any diminution in the value of the goods as a result of handling the goods in a manner other than that necessary to acquaint you with the nature and characteristics of the goods, including their functionality.

So much for the law and now simply in points:

- deliver the goods to the seller's address,
- goods delivered back to the seller's address must be undamaged, complete, including the enclosed invoice and any gifts received with the shipment,
- in the event of the return of damaged or incomplete goods, the purchase price will be reduced by an adequate amount
- do not send goods on delivery - they will not be accepted.

The recommended method of returning the goods is by registered mail, which is registered. In case of loss of the parcel, if it was sent by ordinary mail, the Buyer is not entitled to a refund of the purchase price.

In the event of failure to comply with any of these requirements, the Seller has the right to refuse the returned goods or to reduce the amount for which the goods will be accepted back proportionally.

The option to withdraw from the contract does not apply to the delivery of goods made at the Buyer's request.

The Seller undertakes to refund the Purchaser the purchase price paid within fourteen days of withdrawal, to a bank account which the Purchaser shall notify to the Seller. If the Buyer is no longer able to return the goods in their original condition or their value has already been reduced (partial consumption or damage to the goods), the Buyer is obliged to return the missing value in accordance with the provisions of § 458 paragraph 1 of the Civil Code. to compensate in money - in the form of a set-off against the returned purchase price, which is paid to the Buyer in the reduced value.

VII. Claims for goods

If the Buyer receives goods with a manufacturing defect, he has the right to claim it. Damaged goods must be assessed by the Seller to assess the validity of the claim. Due to the nature of the goods, it is not always necessary to send the goods back to the Seller. A description and photographs of the defective goods are often sufficient as documentation. If the claim is justified, identical goods are sent to the Buyer at the Seller's expense without undue delay.
Warranty period The warranty period for claims is governed by §619-627 of the Civil Code No. 40/1964 Coll.
The warranty does not cover wear and tear caused by normal use.

If the Buyer has chosen a delivery method other than the cheapest one offered by the Seller, the Seller shall reimburse the Consumer for the cost of delivery of the goods in the amount corresponding to the cheapest delivery method offered.

VIII. Personal data protection

Information on the processing of personal data of data subjects pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("the Regulation")

4. Processing of personal data for the purposes of the legitimate interests of the controller or a third party is not carried out.
5. The data subjects whose personal data are processed are: customers and business partners.
6. The scope of the personal data processed is: Name and surname or business name or name of the subject, e-mail address of the subject and postal code of the registered office or permanent residence of the subject.

With the consent of the data subject or on his/her instructions, personal data may be disclosed to other recipients.
8. The transfer of personal data to third countries (outside the EU) or international organisations is not carried out.
9. The personal data was obtained directly from the data subject (by e-mail or in person).
10. The controller processes personal data for the period necessary to fulfil the purpose, but no longer than 2 years after the data was obtained.
11. the controller does not process personal data by profiling or in a similar way based on automated individual decision-making.
12. The data subject shall have the right to request from the controller access to the personal data processed about him or her, the right to rectification of personal data, the right to erasure or restriction of the processing of personal data, the right to object to the processing of personal data, the right to the ineffectiveness of automated individual decision-making, including profiling, the right to the portability of personal data, as well as the right to submit a petition to the supervisory authority to initiate proceedings. If the controller processes personal data on the basis of the data subject's consent, the data subject has the right to withdraw his or her consent to the processing of personal data at any time. The withdrawal of consent shall not affect the lawfulness of the processing of personal data based on consent prior to its withdrawal. 13. The data subject provides his/her personal data voluntarily, on the basis of consent (providing it is not a legal / contractual requirement), in case of non-provision, the newsletter will not be sent to him/her and he/she will not be informed about news, events or other information of customer interest.

IX. Final provisions

These General Terms and Conditions are valid from 1 October 2022. The Seller reserves the right to change these General Terms and Conditions without prior notice.
